Personal Data Processing Information

Milo Tours, member of Italian Association of Travel Agencies (AIAV) hereby declares that any personal data received via phone, electronic forms by email or directly on the website milotours.com will be seen by Milo Tours' data responsible and can be shared with third parties for reservation purposes as hotels, boat companies, tour managers etc. This shall be processed according to the section 10 and 13 of the Italian Law 675/96 in compliance with prevailing data protection conform to the European legislation: art. 13 Reg 2016/679.

 

All personal data retention time will be up to 12 months for contact requests; up to 24 months newsletter, marketing or promotional communications in general; up to 10 years for administrative / accounting / financial documentation relating to the provision of a service. All personal data can be modified or cancelled emailing to info@milotours.com

Who are we sharing your personal data with?​

Supplier(s)

 

Companies, professional offices or offices, independent contractors and freelance who lend assistance and consulting services to Milo Tours S.a.S concerning accounting, administrative, legal, financial and tax matters. All the subjects who are authorised to have access to the data by law or through requests by the authorities.

Milo Tours S.a.S. will process M.O.T.O. (Mail Order Telephone Order) payments, firsthand through Mercury Payment Service S.p.A. member of Nexi Payments S.p.A., Corso Sempione, 55 – 20149 Milano or Axerve S.p.A. Piazza Gaudenzio Sella 1, 13900 Biella, at Milo Tours S.a.S. office, Via degli Aranci 37/3 – 80067 Sorrento, using P.O.S. (Point Of Sale for credit cards) on permanent loan from Mercury Payment Service S.p.a. member of Nexi Payments S.p.A., Corso Sempione, 55 – 20149 Milano or Axerve S.p.A. Piazza Gaudenzio Sella 1, 13900 Biella or "paybylink" with secure code sent directly to the costumers. All M.O.T.O. payments data will be erased after every payment.

Terms & Conditions

We, Milo Tours, a Destination Management Company, member of AIAV, registered in Italy with P.IVA C.F: 09394591219   Licence Number: 9842-05-03-2021 housed in  Via degli Aranci , 37/3 80067 Sorrento (NA), insured with Europe Assistance, act only as an agent in respect of all bookings we take and/or make on your behalf.

 

1. Contract

Making your booking we will provide you a contract with the services you will be provided during your vacation of the requested services arrangements (i.e. land transport providers, private boats or helicopters, guided tours, activities and experiences). As agent we ensure you every possible procedures to maintain our appropriate standards and all our assistance for the proper provision of the services, although we accept no liability for the acts or omissions of the Supplier(s). Your booking with us is binding to these Agency Terms and Conditions and to the specific terms and conditions of the relevant Suppliers we contract with on behalf of you to which your contract is subject and you are considered advised to read both carefully. Please ask us for info & copies of these if you do not have them. All your booking request will be allocated exclusively after we will receive your final confirmation by email and a credit card number.

2. Liability

Milo Tours S.a.S applies every possible procedures and checks to any third parties involved in the preparation and provision of your holiday, to ensure and maintain the appropriate standards of all travel services included in your contract, as set out in your confirmation invoice. We will accept responsibility for the arrangements' service we agree to provide or arrange for you as an agent or organiser. We are responsible for the proper provision of services included in your contract, as set out in your confirmation invoice although we accept no liability for the acts or omissions of the Supplier(s). We accept no liability for any problem due to Public Administration (strike, special events) that will force us to change or cancel your program. We accept no liability in case a transport service, a specific boat or any service included in your quotation program will not be available anymore at the moment you will decide to confirm although we ensure you all our assistance for alternatives that may have different prices. We accept no liability in relation to any other contract you enter into or for any transport arrangements or other services you purchase or for the acts or omissions of any other Supplier(s) or other person(s) or party(ies) connected with any arrangements you enter into that has not been provided by Milo Tours S.a.S. and that is not present in the contract we provide you. We accept no liability in case your booking with us will not be combinable to any transport arrangements or other services you purchase or for the acts or omissions of any other Supplier(s) or other person(s) or party(ies) connected with any arrangements you enter into that has not been provided by Milo Tours S.a.S. and that is not present in the contract we provide you. We accept no liability in case you do not provide us information and specific instructions about any allergies, special diseases or special health conditions or capabilities, in case we set restaurants reservations or outdoor activities for you. We  accept no liability in case will not be possible to attend to all the special requests, you will pass on us, by our Supplier(s). 

3. Booking

We do not process "pure and Simple" booking on third parties' services, in fact we may ask you partial or full payments if required by vendors at the booking. We will consider your services booked at the moment you will carefully read and sign the booking format and we will receive it by your email binding to these Agency Terms and Conditions and to the specific terms and conditions of the relevant Supplier(s) we contract with on behalf of you, considered accepted. The information may be provided to public authorities if required by them, or as required by law. This applies to any special category (sensitive) information that you give to us. In making this booking, you consent to this information being passed on to the relevant persons. Certain information may also be passed on to security or credit checking companies if required to us. 

4. Payment

All M.O.T.O. partial and full payments, for the services included in the contract we send you by email or text or any other form of communication, will be processed firsthand by Milo Tours S.a.S. using exclusively manual (P.O.S.) and digital systems on permanent loan via the two most important bank payment platforms in Italy, accepting payments via Visa MasterCard Amex Digital Payment by 3d secure links: 

Mercury Payments Service S.p.A. members of Nexi Payments S.p.A., Corso Sempione, 55 – 20149 Milano 

Axerve S.p.A. Piazza Gaudenzio Sella 1, 13900 Biella.  

We may ask you for partial or full payments regarding the third parties' booking at the moment of the reservation if requested to us. All the contract payments have to be fully finalised by the time we provide you the services.

5. Special Requests

If you have any special requests, please let us know at the time of inquiring. We will pass on all these requests to the Supplier(s) although we consider you advised in case some last minute requests may not be able to be attended. Please note that Medical issues, towards to the organisation and if related to the outcome of your vacation, must be communicated at the moment of the enquiry to give you the best advice and to try to assist you in choosing the most suitable solution that will meet your requirements. In Milo Tours we consider essential to set all the simplest facilities for disabled guests such as ramps for wheelchairs, lifts and so on. Our experiences and activities require a fair degree of physical fitness. 

6. Changes and Cancellations by You

“Unavoidable and extraordinary circumstances”

You are allowed to cancel your confirmed service/holiday before departure without paying a cancellation charge in the event of “unavoidable and extraordinary circumstances” occurring at your holiday destination and significantly affecting the performance of the service/holiday. In these circumstances, you will be provided with a full refund of the amount you have paid until that moment although we accept no liability to pay you any additional compensation.  We intend as "unavoidable and extraordinary circumstances": significant risks to human health such as pandemic, epidemic or the outbreak of serious disease at the travel destination or natural disasters such as floods, local volcanic eruptions, in earthquakes or acts of terrorism, or weather conditions which make it impossible to travel safely to your destination in  Italy. In case of any official governmental travel restriction to Italy, we guarantee you no penalties on Milo Tours arrangement service and ensure you all our assistance to liaise between you and the Supplier(s) for refund requests regarding the services included in your contract although we will have no further liability to you for eventual penalties applied by them.

"Regular circumstances"

Any cancellation or amendment request must be sent to us via e-mail and will take effect at the time we receive it and reply to you. In case of any amendment please ensure that you have received our confirmation regarding changes to your program via mail. We cannot guarantee that the Supplier(s) will be always in conditions to meet any amendment requests concerning changes although we ensure to you all our effort to find other solutions that might also require extra payments. However amendments and cancellations will be accepted in accordance with the terms and conditions of the Supplier(s) of your booked services

We will inform you about the Supplier’s (Hotels, tour guides, vehicles, boat or airline companies) amendments and cancellation terms request regarding any service present in your contract during your personalised program organisation. We will consider you advised that we always accept on behalf of you the cancellation terms of the Supplier(s) applied to the services at the moment of the reservation and we accept no liability for that.

7. Changes and Cancellations by the Supplier(s)

If Milo Tours is obliged to cancel your service/holiday in any other and Majeur circumstances before departure, we will use our best endeavours to offer you the possibility to postpone your experience/activity/vacation. 

However we will inform you as soon as reasonably possible if the Supplier(s) needs to make a significant change to your confirmed arrangements or to cancel them. Please note that all boat services will be always liable and subject to weather and sea conditions and Supplier(s) can also cancel last minute in case of bad weather preventing in that case full refund or free amendments for same service on different day. We will ensure you our assistance to liaise between you and the Supplier(s) in relation to any alternative arrangements offered by the supplier although we will have no further liability to you.

8. Our Responsibility for Your Booking

As local agent/organiser our responsibilities are limited to the reservation of the services in accordance with your instructions. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on the specific service (or the appropriate proportion of this if not everyone on the booking is affected). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our direct employees whilst acting in the course of their employment.

However, these acceptances of liability do not apply if there has been no fault on the part of the Company or its direct  employees, or if,  the loss, death or personal injury suffered is attributable to (i) your own acts or omissions, (ii)  the acts or omissions of any third parties, (iii) the acts or omissions of any third parties not involved in providing the services which make up your service/holiday and which were unavoidable and extraordinary or (iv) Force Majeure.

9. In Case of...

Any unhappiness regarding any of the part of our arrangement whilst travelling must be reported to us immediately by emailing your feedback/complaints to info@milotours.com. Your prompt report is mandatory to permit us to effect all the inquires and act immediately with Supplier(s). Failure to follow this procedure will deny the opportunity for the Supplier to investigate and rectify your complaint and effect eventual compensations you may be entitled to may therefore be reduced or extinguished as a result.

In case the problem cannot be solved at the moment and you wish to complain, full details must be sent to info@milotours.com in writing to arrive within 30 days of your return. We ensure you to do our best to investigate and reply to you within 28 days of receipt of your email.

10. Law and Jurisdiction

These Agency Terms & Conditions are governed by Italian law and we both agree that the courts of Napoli - Italy, have always and in any case exclusive jurisdiction independently from where ever you leave.

11. Journey Times

The distance and trip time provided on long transportation services are for planning purposes only. You may find that construction projects, traffic, weather, or other events may cause conditions to differ from the original information provided and you should plan your trip accordingly. We ask you to recap always with us timings in case of departures by airplane or train. We remind you to inform always your tour guide and/or driver about boarding and departure times if you are travelling on a cruise ship.

12. Documentation & Information

All descriptions and content on our website or otherwise issued by us is done so also on behalf of the Supplier(s) in question are intended to present a general idea of the services provided by Milo Tours. Not all details of the relevant services can be included on our website to fit in a short description, and many programs may be enriched and upgrade  in order to provide a better experience. 13. Media & Photos

 

Hereby Milo Tours reserves the right to make videos, interviews and take photographs during the activities or part thereof and to use these media contents for promotional purposes. By booking with Milo Tours, guests agree to allow their images to be used for the website milotours.com and approve to publish them on Milo Tours social channels. Milo Tours S.a.S. reserves the right of social directs for promotional purposes. Guests who prefer that their images not be used are asked to expressively deny the consent by writing that at the moment of the reservation.

14. Local Assistance

Milo Tours can provide you locally with appropriate assistance whilst your vacation in case of the need of health services, local authorities and consular assistance. All the costs will be calculated and provided at the moment of your inquire.

By making a contract with us, the first named person on the contract agrees on behalf of all persons detailed on the contract/booking that he/she:

  • read these Agency Terms & Conditions and agree to be bound by them;

  • consents to our use of personal data in accordance with our Privacy Policy and is authorised on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities); 

  • is over 18 years of age (attach a valid id to your reservation form);

  • consents to authorise Milo Tours to the use of media contents for promotional purposes;

  • accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
